OUTZERØ is a mobile application and digital platform for discovering and sharing spots, routes, and alternative travel experiences, nature and adventure.

Accessing and using the platform implies express and unreserved acceptance of these Terms and Conditions.

If you do not agree with these terms, you must refrain from using the application.

2. Nature of the Service

OUTZERØ is a digital platform for discovery, visibility, and technological intermediation.

The application may include:

- Geolocated spots. - Routes and coordinates. - User-generated content. - Activities offered by third parties. - Profiles of partner companies (business mode). - External booking links. - Integrated booking systems in the app (if enabled in the future).

OUTZERØ does not directly organize activities unless expressly stated otherwise.

When the user contracts an activity or service from a third party:

- The contract is formalized directly between the user and the provider. - OUTZERØ acts as a technological platform for visibility or digital intermediation. - OUTZERØ assumes no responsibility for the correct execution of the service. - The fact that OUTZERØ may receive a booking commission does not imply operational responsibility for the activity.

3. Express Risk Warning

Many spots and activities shown on OUTZERØ may involve physical or legal risks, including:

- Mountain hiking. - Cliff jumping. - Explorations in natural environments. - Swimming in natural pools. - Surfing, diving or other water sports. - Access to remote areas. - Activities in unsignposted or unmonitored spaces.

The user expressly declares that:

- They understand the inherent risks. - They assess their own physical condition and experience. - They check weather conditions and the real state of the environment. - They respect local regulations and private property.

OUTZERØ will not be liable for:

- Accidents. - Injuries. - Fines. - Rescues. - Material losses. - Personal injury or harm to third parties.

Use of the information is solely at the user's own risk.

4. Registration and Accounts

To access certain features, creating an account will be required via:

- Email address. - Google authentication. - Apple authentication or other enabled systems.

The user guarantees that:

- The information provided is truthful and up to date. - They have sufficient legal capacity to accept these Terms and use the platform in accordance with applicable regulations. - They will maintain the confidentiality of their credentials.

The user is responsible for all activity carried out from their account.

OUTZERØ may suspend or cancel accounts that breach these terms.

5. User-Generated Content

By publishing content (photos, videos, routes, coordinates, comments), the user declares that:

- They hold the necessary rights over said content. - The content is original and was created by themselves. - It does not infringe the intellectual property rights of third parties. - It does not violate privacy or private property. - They do not publish deliberately false or dangerous information.

Content must be lawful, authentic, and created or captured by the user themselves at the spot or shared experience.

It is expressly prohibited to upload:

- Photos or videos obtained from Google Maps. - Content downloaded from blogs, social media, or external platforms. - Images from third parties without authorization. - AI-generated content that simulates having been captured at the spot without expressly indicating so.

The user grants OUTZERØ a worldwide, non-exclusive, royalty-free, sublicensable license to:

- Reproduce. - Display. - Adapt. - Distribute. - Promote content within the platform and on official brand channels.

OUTZERØ may moderate, edit or remove content that:

- Is illegal. - Is offensive. - Incites dangerous behavior without warning. - Violates regulations or third-party rights. - Is copied or not original.

6. Usage Rules

The following is prohibited:

- Publishing illegal, violent, or discriminatory content. - Sharing sensitive protected locations if prohibited. - Promoting illegal activities. - Using the app for commercial purposes without authorization. - Impersonating others. - Manipulating ratings or reviews. - Scraping or mass extraction of data. - Reverse engineering the system.

OUTZERØ may suspend accounts that breach these rules.

7. Third-Party Services and Business Mode

OUTZERØ may offer visibility to:

- Activities. - Hotels. - Restaurants. - Transportation. - Local businesses.

These companies are responsible for:

- Complying with applicable regulations. - Having mandatory insurance. - Guaranteeing the legality of their services.

Any claim related to a contracted activity must be directed to the corresponding provider.

OUTZERØ will not be liable for:

- Cancellations. - Price changes. - Contractual breaches. - Accidents during the activity.

8. Premium Services

OUTZERØ may offer paid features (e.g. OUTZERØ+).

The pricing terms, renewal, cancellation, and benefits will be specified at the time of purchase.

Non-payment may result in suspension of the premium service.

9. Environmental Respect

OUTZERØ promotes responsible tourism.

The user commits to:

- Not leaving waste. - Respecting flora and fauna. - Not altering the natural environment. - Complying with conservation regulations. - Acting with common sense.

The platform may hide or remove spots if there is environmental risk or overcrowding.

10. Intellectual Property

The name OUTZERØ, logo, design, interactive map structure, iconography, features, texts and source code are the property of their developers.

Their reproduction, copying or exploitation without express authorization is prohibited.

11. Service Availability

The app is provided "as is" and "as available".

OUTZERØ does not guarantee:

- Uninterrupted availability. - Absence of technical errors. - Permanent content updates. - Absolute accuracy of information.

12. Modifications

OUTZERØ may modify these Terms at any time.

Significant changes will be communicated within the app.

Continued use after modification implies acceptance.

13. Applicable Law and Jurisdiction

These terms are governed by Spanish law.

For any dispute, the courts and tribunals of OUTZERØ's registered office shall have jurisdiction, unless otherwise required by law.
